Official Rules, Terms and Conditions

  1. Entry Period: The "RabidPOP Sweepstakes" (the "Sweepstakes") commences at 12:00:01 AM (CST) on June 3, 2008 and ends at 11:59:00 P.M. (CST) on July 31, 2008 (the "Sweepstakes Period"). All entries or submissions must be received by 11:59:00 P.M. (CST) on June 3, 2008. Entries are valid for all Sweepstakes Periods until the Sweepstakes is terminated, which may be done within RABIDPOP's sole discretion.

  2. Sweepstakes Overview: The Sweepstakes is a Sweepstakes wherein entrants freely register with their email address for a free iPhone. Our panel of editors will then judge if the entry conforms with the other Sweepstakes rules. RABIDPOP reserves the right to qualify all entries and to reject any entries that do not meet the requirements for participation as established by RABIDPOP.

  3. Eligibility: The Sweepstakes is open to participants throughout the United States of America, unless such a Sweepstakes/participation in such a Sweepstakes is unlawful in the participant's city, state, local area or district. Residents of Puerto Rico are not eligible. Entrants must be at least 18 years of age or older at time of entry and attend a two- or four-year college or university. Employees (and their immediate families and household members) of RABIDPOP are not eligible to enter the Sweepstakes. By participating in this Sweepstakes, entrants: (a) agree to be bound by these Official Rules and by the interpretations of these Official Rules by RABIDPOP and by the decisions of RABIDPOP, which are final in all matters relating to the Sweepstakes; (b) to release and hold harmless RABIDPOP and its agents, employees, officers, directors, successors and assigns, against any and all claims, injury or damage arising out of or relating to participation in this Sweepstakes and/or the use or misuse or redemption of a prize, and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action; and (c) acknowledge compliance with these Official Rules. RABIDPOP reserves the right, in its sole discretion, to disqualify any entrant who is under a third party agreement, which RABIDPOP deems as contradictory to the nature of this Sweepstakes. Entrants are subject to all applicable federal, state and local laws and regulations.

  4. To Enter: Sign up for a RABIDPOP.COM account, a web site owned by RabidPOP.com, Inc. at any time during the Sweepstakes Period and: (a) electronically agree to the terms of use of the RABIDPOP Privacy Policy and Terms of Use, agree to the Sweepstakes terms & rules then (b) follow the online instructions and enter the Sweepstakes. All entries must include correct name, address, and verifiable Incomplete or inaccurate entries are void. Each unique submission per entrant will count as one entry for the entire Sweepstakes.

  5. Judging Criteria: Judges will make the final decision on the entrant is worthy of the free iPhone. The Judges reserve the right to extend the Sweepstakes Period if they determine, in their sole discretion, that entries received did not meet the minimum qualification standards based on the judging criteria specified herein.

  6. The Winner Selection/Notification: One Winner will be selected by a random drawing after the close of the Sweepstakes. The odds of winning depend on the number of entries received. RABIDPOP. will make up to three (3) attempts over the 72 hour period following Winner selection to contact the potential Winner. RABIDPOP will email the potential monthly Winner at their provided email address and if a phone number was included, RABIDPOP will also call 3 times within the same 72 hour period. If the potential Winner cannot be reached during the 72 hour period in which he/she is emailed such Winner will be disqualified and an alternative Winner will be drawn from among the remaining eligible entries received. In addition, RABIDPOP reserves the right to select an alternative Winner in the event that the Winner fails to comply with these Official Rules.

  7. Winner Verification: The potential Winner must prove eligibility, including, without limitation, proof of age, college-age and email and residence within four (4) days of being notified as a potential Winner. In the event of non-compliance by the potential Winner such potential Winner shall be disqualified and all privileges otherwise due as a Winner shall be terminated and an alternative potential Winner will be chosen from among the remaining eligible entries received . The Winner must sign within four (4) days of receipt of such documents from RABIDPOP: (a) an affadavit of eligibility and release of RABIDPOP and its respective officers, directors, employees, agents, members, affiliated companies and subsidiaries, from any and all liability, loss, claims, demands, and causes of action for personal injury and/or damage, theft, loss, or any other harm suffered in connection with this Sweepstakes or the use/misuse or acceptance of the Prize or any portion thereof, and for any claims based on publicity rights, defamation, invasion of privacy, copyright infringement, trademark infringement or any other intellectual property related cause of action, to be eligible for the Prize; (b) except where prohibited by law, a promotional release granting RABIDPOP the right to use their name and likeness for advertising and publicity purposes without additional compensation, and (c) an assignment of rights to RABIDPOP in and to the submitted entry information. Entry into this Sweepstakes constitutes agreement to sign such releases. The Winner must also complete any additional legal documents provided by RABIDPOP (or third party on its behalf, if applicable) with respect to the Prize and return them as instructed within the time frame specified by RABIDPOP or Prize Winner may forfeit the Prize at RABIDPOP's sole discretion. RABIDPOP expressly reserves the right to delay the announcement of the Winner for creative or technical reasons or for any other reason RABIDPOP deems necessary.

  8. General Terms: Noncompliance with any of these Official Rules may result in disqualification. ANY VIOLATION OF THESE OFFICIAL RULES BY A WINNER OR ANY BEHAVIOR BY A WINNER THAT WILL BRING SUCH WINNER OR RABIDPOP INTO DISREPUTE (IN RABIDPOP’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER'S DISQUALIFICATION AS A WINNER OF THE RABIDPOP SWEEPSTAKES AND ALL PRIVILEGES AS A PRIZE WINNER WILL BE IMMEDIATELY TERMINATED.

    RABIDPOP assumes no responsibility for incorrect or inaccurate entry information whether caused by any of the equipment or programming associated with or utilized in this Sweepstakes or by any human error, which may occur in the processing of the entries in this Sweepstakes. RABIDPOP is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or players on account of technical problems or traffic congestion on the Internet or at any web site, or any combination thereof, including, without limitation, any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this Sweepstakes, or the rules to this Sweepstakes. RABIDPOP is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes, or in the announcement of the Prize or Prize Winner. If, for any reason, the Sweepstakes is not capable of running as planned, including, without limitation, changes in RABIDPOP's web content, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of RABIDPOP, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Sweepstakes or for any reason that RABIDPOP deems it necessary, RABIDPOP reserves the right in its sole discretion to cancel, terminate, modify or suspend the Sweepstakes, or any online voting or entry process, and to determine the Prize Winner is its sole discretion. Should the Sweepstakes be terminated prior to the stated expiration date, notice will be posted on www.rabidpop.com and the Prize will be awarded to winners to be selected from among all entries received up until and/or after (if applicable) the time of modification, cancellation or termination, in the manner described above. All interpretations of these Official Rules and decisions by RABIDPOP are final. No software-generated, robotic, programmed, script, macro or other automated online or text message entries are permitted and will result in disqualification of all such entries. RABIDPOP reserves the right in its sole discretion to disqualify any individual it finds to have tampered with the entry process or the operation of this Sweepstakes; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person or to have provided inaccurate information on any legal documents submitted in connection with this Sweepstakes.

    CAUTION: ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, RABIDPOP RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. THE TEXAS COURTS (STATE AND FEDERAL) SHALL HAVE SOLE JURISDICTION OF ANY CONTROVERSIES REGARDING THE SWEEPSTAKES AND THE LAWS OF THE STATE OF TEXAS SHALL GOVERN THE SWEEPSTAKES. EACH ENTRANT WAIVES ANY AND ALL OBJECTIONS TO JURISDICTION AND VENUE IN THESE COURTS AND HEREBY SUBMITS TO THE JURISDICTION OF THOSE COURTS.

    Past experience has confirmed that Sweepstakes and other any other contests or competitions offered by RABIDPOP may generate substantially similar entries or submissions which closely resemble other submissions or entries or concepts, ideas, and web content that have been independently developed or retrieved by RABIDPOP before or after the Sweepstakes. Accordingly, entrants may subsequently see an RABIDPOP presentation which seemingly incorporates an idea or concept or includes materials similar to that contained in their entries. Any similarity is purely coincidental and unavoidable in light of the volume of web content RABIDPOP routinely considers in the course of their program development. Because of this possibility, entrants hereby agree to submit their entries under the following terms and conditions: (a) that RABIDPOP may use any ideas, concepts, material, in whole or in part, contained in an entry, (b) that all physical materials submitted become the property of RABIDPOP and will not be returned; (c) that all materials submitted are free from any lien or claim by anyone, including, but not limited to any union, guild or performance rights society; (d) entrants have obtained all rights, permissions and licenses necessary for RABIDPOP to use the entries for any purpose; (e) that no entry or any part thereof infringes any trademark or copyright or otherwise violates anyone's right of privacy or publicity; and (f) entrants indemnify and hold harmless RABIDPOP and their respective parent companies, officers, directors, employees, agents, members, affiliated companies and subsidiaries from any claims, suits, losses damages and expenses (including reasonable attorneys' fees) that arise from any breach of the following conditions.

    In case of a dispute over the identity of an entrant who submits a winning entry, the authorized account holder of the email address associated with that entry will be deemed the entrant. The "authorized account holder" is deemed the natural person who is assigned to an email address by an Internet access provider, service provider or other online organization that is responsible for assigning email addresses for the domain associated with the submitted email address. Said entrant must comply with these Official Rules and, at RABIDPOP's sole discretion, may be required to provide proof or ownership of the email account.

  9. Request for Name of Prize Winners and Official Rules: For the name of the Winners and/or a copy of the Official Rules, send a self-addressed stamped envelope to:

    All requests for a copy of the Official Rules and the name of the Prize Winners must be made by the 15th of the month following the announcement of the Sweepstakes Winner of that particular Sweepstakes. Please note on the front left-hand corner of your outer envelope whether you are requesting "Official Rules" or the name of the "Winners."
